What is the personal injury claims process?

While no two claims are ever the same, the personal injury claims process generally unfolds according to a set structure. Switalskis can represent you at all stages, no matter what happens - from a free consultation where we'll discuss your situation, to the day you receive your compensation, and beyond. The legal process usually proceeds as follows:

Step 1: Initial consultation

We offer a free consultation where we can discuss your accident and the injuries you suffered. We'll evaluate the evidence and determine whether we think you're entitled to compensation. If you have a strong claim and want to move ahead, we'll explain what to expect from the process and get things started on your behalf.

Step 2: Establishing your claim

Switalskis will start to gather evidence about the circumstances of your injury to show that the injury or illness was caused by someone else, that it would not have happened otherwise, and who is liable for it. This can include everything from witness statements to CCTV footage, and will usually involve an independent medical expert assessing your medical records to offer their opinion. All the information we collect helps us to build a strong case.

Step 3: Notifying the defendant

We'll send a letter of claim to the person or organisation that we believe is liable for your injury. This will explain the evidence we've collected, and include our calculation of how much compensation you can expect to receive. Once we've sent the letter, the defendant will have a few months in which to investigate and decide whether to accept or deny liability.

Step 4: Negotiation

If the defendant accepts liability, we can start to negotiate the amount of compensation you should receive. This is how most personal injury claims are resolved, without the need for court proceedings. We'll strive to secure the maximum amount of compensation for you, and we're not afraid to take things to court if the other party won't offer a fair settlement.

Step 5: Court proceedings (where necessary)

When the defendant will not offer a fair settlement or denies their responsibility, we'll issue court proceedings. We'll present the evidence to a judge and stand by you until the final hearing to make sure you receive the maximum amount of compensation that you're entitled to.

Step 6: Settlement and compensation

If your claim is successful, you'll receive compensation awarded by the judge, either as a lump sum or as a series of payments over time. For claims made on a no win, no fee basis, you'll also pay your legal expenses at this point in the form of a success fee for your solicitor. In some cases, your solicitor may seek interim payments, which means you can receive a portion of your compensation early.

We know that the claims process can be daunting, but we're here to make it as smooth as possible.

Is there a time limit for a personal injury compensation claim?

In most cases, you must make a personal injury claim within three years from the date of the injury or the date you first realised the injury was linked to the accident or negligence you experienced. However, there are some exceptions, so it's worth speaking to a solicitor if you're unsure.

  • Children: for claims involving children, the three-year time limit starts from their 18th birthday. A litigation friend can claim on their behalf at any time before this, or the child themselves can start a claim before they turn 21.
  • Mental capacity: if the injured person lacks mental capacity, there may be no time limit unless they regain capacity.
  • Fatal accidents: when a person dies because of their injuries, family members can start a claim within three years of their date of death, or the date the family became aware of the cause.

Our Sheffield solicitors can advise you on whether or not you're eligible to claim and make sure to meet any relevant time limits when we take on your case.
