This policy outlines the procedure for handling complaints regarding personal data mishandling, unauthorized access, or breaches of rights under the Data Use and Access Act (DUAA). It applies to all personal data processed by Switalskis Solicitors.

Switalskis Solicitors handles complaints according to the following statutory steps:
We will acknowledge receipt of your complaint in writing within 30 days.
We will investigate the circumstances of the breach or complaint without undue delay. If the investigation is complex or delayed, we will keep you regularly updated on our progress.
Once the investigation is complete, we will provide a meaningful, documented response detailing our findings and any remedial actions taken.
If you are dissatisfied with our final response or how we handled your complaint, you have the right to escalate the matter to the Information Commissioner's Office (ICO).
All records regarding DUAA data protection complaints will be safely stored and documented in compliance with Switalskis Solicitors data retention policy.
The Data (Use and Access) Act 2025 requires us to help you if you wish to make a complaint about how we use your personal data. Should you wish to raise a complaint about a potential breach of your personal data or if you have any other concern about our handling of your personal data, please complete this data protection complaints form. Alternatively, you may wish to write to Susan Willoughby or Steve Dibb in the Risk & Compliance Department by email clientcare@switalskis.com or by post to 40 Ropergate, Pontefract, WF8 1JZ they will assess and respond to your complaint in accordance our Privacy Notice. In particular, they will acknowledge your complaint within 30 days and, without undue delay, take appropriate steps to respond to the complaint and inform you of the outcome.
In the event of an allegation of a breach of Personal Data and/or any concern that our firm has not handled your personal information properly, we will consider whether a report needs to be made to the Information Commissioner’s Office (ICO). Not all breaches are reportable and we will advise you of the results of our assessment.

You also have the right to lodge a complaint with the ICO provided that you have first allowed us the opportunity to attempt to resolve it ourselves.
