Former Private School Teacher Convicted of Historic Sexual Abuse Offences
By Hannah Hodgson
This week, a former private school teacher has been convicted of tens of historic child sexual abuse offences committed against pupils at a school in East Sussex.
Sadly, this is one of many cases we see in the media where a teacher has abused their position.
David James Clarke, 82, was found guilty at Lewes Crown Court of 45 child sexual abuse offences relating to former pupils at Newlands School in Seaford during the 1970s and 1980s. He abused boys while working as a teacher and while running a school photography club. He took advantage of his position of power over the children in his care.
Clarke was found guilty of offences including indecent assault, indecency with a child, buggery and offences relating to indecent images of children. The CPS said he used his position of trust to isolate and abuse vulnerable children, often in a dark room that he to run a photography club with the pupils of the school.
So far, 14 male survivors have been identified, many of whom carried the trauma of the abuse for decades before feeling able to come forward. These survivors have rightly been praised by the police for their “incredible bravery”, which led to the successful prosecution of their abuser decades later.
We often see that people in positions of trust use such position to groom and gain the trust of children, especially those in vulnerable situations. Often a child believes, it is their fault or that they had consented in some way, that they are the only one which is never correct. An abuser will be confident that their abuse will go undetected and often does for many years. Following convictions in abuse cases, it is not uncommon for other survivors to recognise similar experiences and find the confidence to speak out for the first time.
If you were abused by David James Clarke, or experienced abuse at Newlands School, The Manor School, or any other educational institution, you are not alone and support and legal advice are available to you.
It is widely recognised and understood that survivors of childhood abuse do not often report what happened to them until years later. This can be because of many different reasons including fear, shame, manipulation, trauma, or worry that they will not be believed. The law recognises this, and historic abuse claims can still be pursued long after the abuse took place.
Can I Bring a Civil Claim for Historic Abuse?
Survivors of childhood sexual abuse may be able to bring a civil compensation claim
A civil claim is separate from any criminal proceedings. While no amount of compensation can undo the harm caused, a civil claim can help survivors obtain justice even where there has been no prosecution or conviction. This is because survivors may still be entitled to seek compensation and accountability through the civil courts.
In many abuse cases, institutions can be held responsible where there were safeguarding failures, ignored warnings, or failures to properly supervise staff.
We have significant experience in representing survivors of abuse in educational settings, including both private and public schools, education organisations and associated clubs linked to schools.
Our expert solicitors here at Switalskis understand how difficult it can be to speak about abuse, particularly where the events happened many years ago. We approach every case with sensitivity, confidentiality and compassion.
