How Switalskis can help

When you make an amputation compensation claim with Switalskis, you get more than just legal advice. We have a specialist team of serious injury solicitors who understand the specific needs of a person who has experienced an amputation, and we’ll work to provide the resources you need to live as independently as possible, even before your claim has concluded.

Our support starts straight away. Because financial pressure can mount quickly after a serious injury, we seek interim payments whenever possible. These are early payments of a part of your compensation that can cover immediate costs like private medical care, specialist equipment, or home adaptations before your final settlement is reached. Our amputation solicitors will also connect you with leading medical experts and occupational therapists to create a bespoke rehabilitation package.

We take the time to discuss your situation in detail, which allows us to tailor our support and pursue the maximum compensation for you. Our expertise allows us to handle complex cases involving contributory negligence or disputed liability, and break them down into simple terms so that you're never confused during the legal process. We’ll carry out thorough initial investigations, gather medical records and witness statements and build a strong case on your behalf. By choosing Switalskis, you’re choosing a firm that combines legal excellence with genuine empathy, and a serious injury lawyer who'll be with you at every step, from your initial consultation to the conclusion of your claim.

When can you make an amputation injury claim?

An amputation injury claim is usually possible if you have experienced the loss of a limb or digit in circumstances that were not your fault. Together with your solicitor, you must prove that another person or organisation was at fault for your injury using a combination of different types of evidence. When you call Switalskis, we'll talk about your circumstances and the evidence available to evaluate whether or not you are in a position to claim amputation compensation.

While more severe amputations generally attract higher awards for pain, suffering and loss of amenity, the overall value of a claim depends on the individual circumstances, including the impact on employment, care needs and future losses. The amount you receive will be tailored to your specific needs and the overall impact of the injury on your life moving forward.

Amputations that happen in many different environments can result in a compensation claim. Our specialist amputation lawyers have experience in handling cases arising from a wide range of serious accidents, including:

Road traffic accidents

High-speed collisions can result in traumatic amputation. Motorcyclists and pedestrians are particularly vulnerable to limb loss in road accidents because they are not as protected as vehicle drivers. If another road user was negligent, a claim will usually be pursued against them, with their insurance company handling the claim. We’ll investigate the crash scene, review police reports, and speak to witnesses to establish liability.

Accidents at work

Industrial settings, construction sites, and factories use heavy machinery that can cause devastating injuries. If an employer fails to provide proper training, safety guards, or personal protective equipment, they may be liable for the injury. Many successful amputation claims arise from "entrapment" accidents where a limb is caught in moving parts, but these are not the only circumstances where a claim is possible. Employers have a legal duty to take reasonable steps to protect workers from avoidable risks, and any amputation that happened because of an accident at work could entitle you to compensation.

Medical negligence

Sometimes, the loss of a limb is necessary in a medical or healthcare setting. However, if it could have been prevented, you may still be able to claim. For example, if a healthcare professional failed to diagnose a condition like or diabetes-related complications, and this led to the need for a surgical amputation, you could make a medical negligence claim.

Negligent care for which you may be able to claim also includes surgical errors or the failure by healthcare practitioners to treat infections properly. Switalskis has a dedicated medical negligence team to hold doctors, surgeons and other practitioners accountable, and deliver the compensation you deserve.

Accidents in public places

Falling objects, poorly maintained premises, or structural collapses in public places can lead to serious injuries and limb loss. If the person or company responsible for the space didn't keep it safe, we can help you to claim compensation by resolving the complex liability issues at the heart of these cases.

How much compensation can I get for an amputation?

The goal of an amputation injury claim is to put you back in the financial position you would’ve been in if the accident hadn't happened. As such, every case is unique, and the final settlement depends on the severity of the injury and its impact on your life.

When we calculate your amputation compensation, we look at your needs for the rest of your life, to make sure you’re not left struggling financially in the future. Compensation is split into two categories: general damages and special damages.

General damages cover the pain, suffering, and "loss of amenity" (the loss of the ability to enjoy life). These are calculated based on the Judicial College Guidelines, which provide recommended compensation amounts for different types of injuries. They also include the impact of amputation, which might include depression, anxiety, post-traumatic stress disorder, body image issues and other mental health challenges.

Special damages cover your actual financial losses, which can include:

  • lost earnings, if you can no longer work or have to take a lower-paying job.
  • medical expenses for private surgery and any ongoing physical or occupational therapy.
  • costs for high-quality, custom prosthetics, and for replacements when they are necessary.
  • home adaptations such as ramps, widened doors, or wet rooms.
  • care costs, including professional care and support with daily tasks and personal care provided by family and friends.
  • travel expenses for attending medical appointments.

Early rehabilitation is a cornerstone of recovery after limb loss, and an amputation injury claim should deliver funding for a rehabilitation package that goes beyond standard care, and pay for a custom prosthetic that offers better mobility and comfort. Switalskis will work to demonstrate that this support is necessary to your recovery and secure fair compensation that will cover the costs.

What is the amputated limb compensation claims process?

Making a claim can feel daunting, but Switalskis will break the claims process down into manageable steps. We’ll prepare you for what to expect from the start, and keep you informed throughout the entire journey so you'll always know what to expect. The claims process follows strict legal requirements and usually unfolds as follows:

Initial consultation

The process starts with an initial consultation , where we’ll listen to your story, ask questions about how the injury happened, and offer free advice about your legal options. This is your chance to meet our specialist amputation lawyers and see how we work. We won't pressure you to proceed, but if you decide to do so, we can get started on your claim straight away.

Establishing your claim

If you decide to make a claim, we’ll start gathering evidence . This involves getting your medical records, witness statements, photos and videos, and any relevant police reports. We may also work with a leading medical expert to examine you and provide a report on your injuries and future needs.

Notifying the defendant

We’ll contact the person or organisation responsible for your injury (the defendant). We’ll set out why we believe they’re at fault, and they’ll have a set amount of time to investigate and respond. They may admit or deny liability for your accident.

Negotiation

If the other party accepts their liability, our amputation claims lawyers will begin negotiating a fair compensation amount. We’ll use the evidence we’ve gathered to show the full extent of your financial losses and the impact on your quality of life. Most amputation claims are settled during this stage through negotiations with the insurance company. Where appropriate, we will seek early rehabilitation under the Rehabilitation Code to ensure access to treatment and support at the earliest opportunity.

Court proceedings (where necessary)

If the defendant denies liability or we can't agree on a fair settlement, we may need to start court action . This doesn't always mean you’ll have to go to court; many cases settle before the trial date. We’ll handle all the paperwork and represent you throughout any hearings to pursue the compensation you're owed.

Settlement and compensation

Compensation may be paid as a lump sum, or in some high-value cases through a combination of a lump sum and ongoing periodical payments . Where the injured person is a child or lacks capacity to manage their own affairs, any settlement must normally be approved by the court. The money can be used to fund your care, equipment, and future security.

FAQs about amputation claims

How long does it take to make a claim?

Amputation claims are complex and can take several years to settle. We need to understand the full, long-term impact of your injury before we can agree on a final figure. This means waiting until your medical condition has stabilised and your future prosthetic and care needs are clear.

When you work with Switalskis, you won’t be left without support during this time. We’ll seek interim payments for immediate needs, like lost income and medical costs, while your claim is ongoing. These payments, and our no win, no fee arrangement, mean that you won't face unnecessary financial hardship even if the claims process takes a long time.

How are amputation claims funded?

Most of our amputation claims are handled on a no win no fee basis. This is formally known as a Conditional Fee Agreement. It means there’s no financial risk to you if your claim isn't successful, as you won't have to pay legal fees.

We’ll explain the fee arrangement and claim details clearly at the start. There are no hidden costs, and we’ll discuss any insurance needed to protect you from the defendant's costs. This way, you can seek justice without worrying about how to pay for a specialist solicitor. Our no win no fee model is designed to give everyone access to high-quality legal representation regardless of their financial situation.

Is there a time limit to claim amputation compensation?

There's usually a three-year limit to start a personal injury claim (or medical negligence claim). This time limit usually starts from the date of the accident or the date you realised your injury was caused by negligence.

There are some exceptions:

  • For children, there is no time limit until they turn 18. At that point, the three-year limit begins.
  • If the person lacks the mental capacity to make their own decisions, there’s no time limit unless they recover that capacity.

It’s always best to seek legal advice as soon as possible. Starting early makes it easier to gather fresh evidence and secure early interim payments. Waiting too long can make it harder to find the necessary evidence.

Can I claim if the accident was partly my fault?

You can often still make a claim if the accident was partly your fault under a principle called "contributory negligence." It means that your solicitor will agree with the defendant on the extent to which you were responsible and your compensation will be reduced by an equivalent percentage. If you were 25% responsible, you would receive 75% of the compensation you'd otherwise have received.

Can I claim for "phantom limb" pain?

Phantom limb pain is a real and often debilitating condition where you feel pain in the limb that’s no longer there. This is taken into account when assessing your pain and suffering (general damages) and when planning your medical care and rehabilitation package.
