Historical child abuse survivor awarded £750,000 compensation

A survivor of historical child abuse has been awarded £750,000 in compensation after seeking the advice of Switalskis' nationally recognised child abuse compensation team. This is one of the largest settlements achieved in this sector in recent years and highlights the importance of expert legal representation in complex abuse claims.

Case study: historical abuse claims at private schools
Our client, referred to as PQR, was sexually abused by two teachers at his private school between 1991 and 1994. His abusers were convicted in 2017, a crucial turning point that allowed him to take legal action.
Despite these convictions, the school sought to defend the case on several grounds, arguing that:
- The claim was out of time.
- They were not vicariously liable for the actions of the abusers.
- The abuse had not directly caused PQR’s long-term financial losses.
Challenges in pursuing historical abuse compensation claims
The case proceeded to a hearing at the Royal Courts of Justice between 16 and 20 July 2023 before Mr Justice Ritchie. Psychiatric and employment expert evidence was vital in demonstrating the lasting effect of the abuse on PQR’s career.
On the morning of the fifth day, the defendants agreed to settle, awarding PQR £750,000 plus legal costs.
A significant part of the claim related to loss of earnings and pension, making causation a critical factor. In historical abuse cases, it is essential to show a clear link between the abuse suffered and any financial losses. Without this connection, claims for lost earnings may be significantly reduced or unsuccessful.
