During difficult times, it's hard to know where to turn for help. Our child care and domestic abuse solicitors are holding free drop-in clinics on the last Thursday of every month at the Greenwood Centre, Ravensthorpe. In partnership with Kirklees Domestic Abuse Specialist Services (KDAS) , the sessions offer a safe, discreet and supportive space for anyone who needs advice or support.

We have Urdu, Gujarati and Punjabi speaking solicitors.

If you are experiencing domestic abuse, our child care legal team are here to help you. This may include physical, emotional, financial or controlling behaviour. We will listen carefully and act quickly to give you clear advice and help you feel safe.

We support people affected by all forms of domestic abuse and violence, including physical, emotional, sexual and financial abuse, as well as coercive or controlling behaviour. We can talk you through your options and support you in taking the next steps, including helping you apply for protective orders such as non-molestation orders and representing you in court if needed.

Domestic abuse should be reported to the police, even if you are not in imminent danger. The police are trained to respond effectively to survivors of domestic abuse. Domestic abuse support services are also able to offer free, confidential advice.

Types of orders and how they protect you

There are two types of orders available for domestic abuse survivors that our childcare legal team can help you with:

Non-molestation orders aim to ensure your health, safety and wellbeing. They prevent a person from:

  • Using violence
  • Threatening violence
  • Intimidating you
  • Harassing you
  • Pestering you

Occupation orders say who can live in a property.  An occupation order can only be made for six months and doesn’t change the ownership of a property.

For both types of orders, the family court will have to decide if you are at risk of significant harm and what the possible harm is to you (and your children if applicable) if no order is made. Importantly, there are no court fees associated with obtaining non-molestation orders.

How to find us

The drop-in clinics are held on the last Thursday of every month, located at the Greenwood Centre, Ravensthorpe. Join us in a safe, discreet and welcoming place, to chat with our domestic abuse and care solicitors in joint partnership with Kirklees Domestic Abuse Specialist Services (KDAS).

No appointment is necessary, simply drop-in between 1pm - 3pm for advice and support.

Non-molestation and occupation orders

How do you apply for a non-molestation or occupation order?

We can apply for a non-molestation order and/or an occupation order on the same day if needed, especially if you’re in immediate danger, emphasising the urgency and support our lawyers will provide in critical situations. This can be done without the other party being present.

How long does it take for a non-molestation order to be served?

As soon as the order has been made we can arrange for enquiry agents to personally serve the order on the perpetrator quickly and efficiently. 

What happens if the other party breaches a non-molestation or occupation order in a domestic abuse case?

Breaching a non-molestation order or an occupation order is a criminal offence. You should notify the police of a breach as soon as the crime happens.

Breaching an order can lead to arrest by the police, who will prosecute the offender. This criminal offence carries a maximum sentence of five years in prison, emphasising the serious consequences of such criminal actions.

How are non-molestation orders and occupation orders funded through legal aid?

We understand that the last thing you’d want to worry about is how to pay for the necessary legal support. You can be assured that there are many options and we aim to provide helpful support throughout the legal proceedings:

Legal aid: You may get legal aid if you meet the financial eligibility criteria. We’ll advise you about the information and evidence you will be asked to provide and we’ll make the application to the Legal Aid Agency for you if we think you will qualify.

Fixed fees: Knowing what you’ll pay upfront can ease your worries. For some services, we offer fixed-fee packages to help you plan and manage your finances better.

Private funding: If you do not qualify for legal aid, we offer competitive hourly rates and we will remain focused on providing you with a cost-efficient service.
