Can I make a brain injury claim for my child?

If your child has suffered a brain injury because of someone else’s negligence, you can usually make a brain injury claim on their behalf. Since children under 18 cannot start legal proceedings themselves, a parent or guardian must act as a litigation friend to start the claim.

To make a successful claim, we must show that your child sustained a brain or head injury in an accident that was not their fault, that another person owed them a duty of care and was negligent in exercising that duty, and that this was the cause of the injuries sustained. There are many circumstances in which these circumstances arise:

  • Road traffic accidents: these are a leading cause of head injury claims. Children can be injured as passengers, pedestrians, or cyclists.
  • Birth injuries: medical negligence during pregnancy or delivery can lead to an acquired brain injury. A lack of oxygen to the brain or physical trauma during birth can lead to a brain injury. In some cases, these injuries result from avoidable failures in medical care.
  • Falls: falls are a common cause of child brain injuries, especially in younger children. Depending on where the child fell, what led to the fall and who was supervising the child at the time, they may be entitled to claim for a brain injury following a fall.
  • Sports injuries: contact sports can sometimes lead to serious brain injuries if the right safety measures are not in place.

If you believe you may be entitled to claim, the experienced solicitors at Switalskis can investigate the facts on your behalf to identify whether someone else is at fault for your child's injuries, and advise you on whether you're able to claim compensation. If so, our serious injury team will help you through every part of the injury claims process and work to secure a fair settlement based on the specifics of your child's case.

What is the claims process for child brain injury compensation?

The process for a personal injury compensation claim generally follows the same structure, even when the specific details are very different from case to case. The legal process can feel daunting, but Switalskis aims to break things down into clear steps and our brain injury team will be on hand to guide you through each stage.

Initial consultation

The process starts with an initial consultation . This is a chance for you to tell us what happened. We’ll listen with empathy and give you honest, expert legal advice about your options. We’ll explain how we can help and what the next steps will be for your child's brain injury claim.

Establishing your claim

If you decide to move forward, we begin to gather evidence and conduct an investigation into your child's brain injury. Our team will collect medical records, witness statements, and accident reports, and work with independent medical experts to understand the full extent of the brain injury to determine how much compensation you can expect to receive.

Notifying the defendant

Once we've built a strong case, we'll send the person or organisation responsible for the brain injury a formal letter of claim . We set out the details of the brain injury claim and why we believe they’re at fault for the child's serious injuries. They’ll then have a set amount of time to investigate, respond and accept or deny liability.

Negotiation

Most child injury claims are settled through negotiation, without the need to go to court. If the defendant admits liability, our expert brain injury solicitors will talk to their insurance company and legal team, and aim to agree a settlement that covers all your child's needs. We often seek interim payments during this time to help with immediate costs like rehabilitation or specialist equipment.

Court proceedings

If the defendant doesn’t admit fault or won't agree on a fair amount of brain injury compensation, we may start court proceedings . While this may sound daunting, most injury claims still settle before they reach a full trial and it's rare that you'll be expected to appear in court. If your case does go to court, our brain injury solicitor will be there to represent you and fight for your child's rights.

Settlement and compensation

When a brain injury claim is successful, a judge must approve the settlement to ensure it’s fair and in your child's best interests. In many cases, compensation awarded to a child is managed on their behalf until they reach adulthood. Where a child lacks mental capacity after reaching adulthood, the Court of Protection may become involved to manage their compensation on their behalf. The compensation can be a lump sum, periodical payments, or a mix of both, depending on what the child needs to maintain financial security.

How much compensation will my child receive?

A serious brain injury can have life-changing consequences for the rest of a child's life, and compensation is calculated to reflect this serious impact. There are two elements to the compensation payments for brain and head injuries: general damages for pain and suffering, and special damages for financial losses.

General damages compensate for pain, suffering and loss of amenity resulting from the injury. If a child's brain injury causes permanent side effects, this will typically result in more compensation than if they are likely to make a full recovery.

Brain damage can affect a child’s:

  • physical movement and coordination.
  • ability to communicate and speak.
  • cognitive functions like memory and problem-solving.
  • emotional regulation and social skills.

Our personal injury solicitors work to ensure that the compensation claim reflects all these factors.

Special damages are for financial losses related to an injury or clinical negligence experienced by the child. This includes the costs for any medical treatment, rehabilitation or therapy, but also things like transport to and from medical appointments, or a parent's lost earnings if they have taken time away from work to care for the child. If your child needs lifelong care or help with daily tasks, this should be factored into compensation.

We look at what the child's life would’ve been like without the injury, and the financial challenges the family may face, to calculate a fair compensation amount. Some cases are complicated by the presence of spinal injuries that make care needs more complicated, and any spinal cord damage can also be accounted for in a personal injury settlement.

As such, there is no standard compensation amount for claims like these. Speak to the team at Switalskis and, following our initial investigations, we can offer practical advice about how much compensation you should expect to receive.
