Securing compensation after workplace safety failures result in avoidable injury

Ian Latimer, solicitor in our serious injury team , recently supported a client following a workplace accident that, with the right precautions in place, could have been avoided altogether.

An avoidable injury

In 2022, our client was working on a building site using a scaffold podium when an incident occurred. One of the podium’s wheels became caught in an uncovered crevice in the floor, causing the equipment to topple. As a result, our client suffered a traumatic dislocation to his left shoulder.

Ian led a detailed investigation into the circumstances of the accident, identifying clear and multiple safety failings. The podium should have been fitted with stabilisers, and the crevice in the floor should have been properly covered. Either measure could have prevented the accident.

We pursued a claim against both the main contractor, responsible for overall site safety, and the sub-contractor who had supplied the podium.

Liability was firmly denied by all parties, and Court proceedings were issued. The sub-contractor later sought to shift responsibility to our client’s employer, alleging inadequate training. This was also disputed.

As the case progressed, all parties disclosed evidence and exchanged witness statements. Our team obtained expert medical evidence from an orthopaedic surgeon, and the claim was prepared for trial. Shortly before the hearing, and following Ian’s persistent and strategic approach, the defendants agreed how responsibility should be apportioned. The case settled for just under £60,000.

While this brought a positive outcome for our client, the case highlights how delays in accepting responsibility can prolong uncertainty for those affected.
