Successful defence for aggravated assault for client presenting with potential dementia

Our client was in their 60’s with no previous convictions who was charged with stabbing a relative. Given the serious nature of the allegation, and how the client was presenting in interviews, an assessment was carried out to evaluate their mental capacity. Early signs of mental illness were identified, and expert psychiatric evaluations were commissioned.

The assessments confirmed that the client was unfit to plead. The expert believe it was likely they had either dementia or a severe depressive illness. Using this evidence, the defence successfully secured a hospital order with restrictions under the Mental Health Act. This meant that the client received appropriate treatment rather than facing imprisonment.
