Organised by Switalskis, the sold-out Annual Review of Mental Capacity Act 2005 is a significant event for Court of Protection (CoP) health and welfare specialists. In its 14th year, 280 delegates from legal, healthcare, and social care sectors will gather to explore the latest developments, challenges and opportunities surrounding the Act.

The Honourable Mrs Justice Theis DBE, vice president of the Court of Protection, will deliver the keynote address. She leads a panel of speakers, including Joseph O’Brien KC and Parishil Patel KC, who will discuss best interest decisions within the CoP. Dr Chris Ince will talk about capacity assessments for sexual relationships, while Dr Catriona McIntosh will focus on financial capacity.

Lorraine Cavanagh KC joins the panel to address the growing importance of transparency in CoP cases, and Ben McCormack will share insights on housing law. In addition, Natalia Levine will offer practical guidance for professionals navigating the complexities of CoP and care proceedings.

Alison Kaye, director and head of the Court of Protection Health and Welfare at Switalskis, says: “We’re very proud that our conference has become an essential forum for those advocating for vulnerable people. The calibre of speakers reflects the high standing of the event and ensures that delegates gain practical insights into the legal, medical, and ethical challenges faced. It’s also, importantly, an opportunity for collaboration, learning, and advancing the protection of individuals who lack the capacity to make decisions for themselves.”

When someone close to you can no longer manage their own finances or make decisions about spending their money, there’s a real risk that money could be misused or essential bills left unpaid. Sometimes, family members try to help without the right legal authority; other times, vulnerable people are at risk of being exploited. Acting early to safeguard assets protects the person and reduces the chance of future disputes, when emotions are high as estates are being distributed and money has been spent.
