Successful defence of death by careless driving

The client was charged with causing death by careless driving. They were a person of good character who had been driving to work and collided with a cyclist whilst turning at a junction. The cyclist unfortunately died because of their injuries.
The client had been driving within the speed limit and had not performed any inappropriate manoeuvre that caused the incident. The low winter sun had momentarily blinded them in the seconds before approaching the cyclist.
An expert report was obtained from an accident investigator. The trial ran over a week at Leeds Crown Court. The client was found not guilty by the jury, who were convinced that the low winter sun would have affected any careful driver in the same way and that this was a truly tragic accident.
