She also supervises the fixed costs team within the personal injury department and helps to update systems and procedures for dealing with fixed costs cases.
APPROACH
Kelly tries to deal with each client in a friendly and approachable manner. She will assess each claim at the outset and determine the best course of action. She is organised and ensures she reviews each case regularly in order to keep clients up to date with progress. Kelly supervises and trains other members of staff and has an open-door policy for colleagues.
EXPERIENCE
Kelly has worked in personal injury for over 15 years and during that time has dealt with cases ranging from £1,000 to over £50,000. She has dealt with a broad range of accidents from road traffic accidents, accidents at work, slips and trips on the highway or in public premises.
Kelly helped set up the systems and procedures for dealing with fixed costs cases when the new Low Value Protocols came into force in 2010 and 2013 and continues to adapt and evolve these as we encounter different challenges.
She has also dealt with an accident at work claim which settled close to trial. The claim was originally subject to fixed costs, but Kelly obtained a settlement for the client which included a consent order with the Defendant for costs to be assessed. The Defendant subsequently appealed the costs due on this matter and argued fixed costs should apply. The claim was heard in the Court of Appeal where we successfully argued the Defendant had contracted out of fixed costs.
