The background of the case

Our client was just 15 years old at the time of the allegations. He lived at home with his mother and a much younger half-sister.

Concerns arose following a visit from a social worker to the family home. During the visit, the younger child made allegations of inappropriate sexual touching from her older brother. These allegations later expanded during a formal police interview, where more serious claims were made about our client, including an allegation of rape.

Our client strongly denied all allegations from the outset. He had no previous convictions and was of good character.

The legal journey

Head of the Criminal Law department, specialist crime solicitor Michael Devlin , represented the client from his first appearance at the Youth Court. The case was treated with the utmost seriousness due to the nature of the allegations and was sent to the Crown Court as a grave crime.

Given the age of the complainant, special measures were put in place. This included pre-recorded cross-examination, requiring early and detailed preparation. Our legal team worked closely with the client from the very beginning to ensure he understood the process and was able to effectively participate in his defence.

A key element of the prosecution case relied on expert evidence which was carefully scrutinised by the defence. It was successfully argued that aspects of the expert’s opinion went beyond their area of expertise and lacked proper evidential foundation. As a result, the jury at the first trial reached not guilty verdicts on the most serious allegations, including rape.

Due to factors outside the control of the defence, the case was delayed over several years. By the time the matter returned to court for a retrial, our client was no longer a child but a young adult.

At the conclusion of the retrial, the jury found him guilty of two counts of sexual touching.

The outcome

Despite the convictions, the court imposed a suspended sentence. This outcome avoided immediate custody and recognised a range of important mitigating factors, including:

  • The client’s age at the time of the alleged behaviour
  • His lack of previous convictions
  • The significant passage of time since the allegations
  • The wider context in which the behaviour was said to have occurred
