When bones are fractured, they need to be treated so that the injury can heal properly and as quickly as possible. More pain can occur if the fracture is not properly diagnosed, and further damage can occur. Your GP or healthcare professional has a responsibility for your diagnosis and treatment.

A fracture may be misdiagnosed due to incorrect x-ray readings, miscommunication about the x-ray results, failure to pass the information on to a doctor or even failing to request an x-ray altogether. A mistake such as these could mean you have grounds for a medical negligence claim.

How do I know if I have experienced a missed fracture?

There are various symptoms of a missed fracture which you may have experienced, such as:

  • Bruising of the fractured area
  • Significant swelling
  • A numb sensation or pain

These are some of the common indications that you may have a missed fracture and need to see another medical professional.

When can I make a missed fracture claim?

In most cases, missed fracture claims need to be made within three years from when you either suffered negligent care, or three years from when you first discovered your injury. However, this time restriction can vary depending on the circumstances of your case. For example, when making a claim for a child, the three year time restriction begins after the child turn 18 years old. Likewise, someone who lacks mental capacity and cannot make a claim on their own may also be exempt from the restriction.
