What is Family Mediation?
Family Mediation is a way of solving disputes between you and your ex-partner, by working together to ensure that beneficial decisions are made on behalf of each of you. At Switalskis, our experienced family mediator will meet with you and your ex-partner, both individually and together, to discuss your thoughts and disputes. We will guide you towards making amicable agreements through a series of meetings, the number of which can differ depending on the number of issues to settle.
Our family mediation solicitor will recommend finding appropriate legal advice throughout the mediation process. Family mediation is intended to provide a safe and impartial alternative to making decisions. The mediator cannot provide advice to either party, however they can impart legal information should you require it. It is encouraged that you also appoint a qualified solicitor to work with you, especially towards the end of the process so that they can write up your agreements which can then be incorporated into a formal separation agreement or court order as appropriate.
You are required to attend a ‘mediation information and assessment meeting’ (MIAM) if you are seeking a court order to resolve a dispute over children, property or financial matters. At Switalskis, we offer MIAMs, as well as a full Family Mediation service.
Who pays for Family Mediation?
Legal aid is still available for some of our cases, depending on the circumstances. ‘Help with Mediation’ may also be available to cover the cost of obtaining legal advice in the context of ongoing mediation appointments. This would cover help such as advising as to the fairness of any agreement reached during mediation and formalising the agreement through the courts. If, upon assessment of your financial circumstances, you do not qualify for the public funding outlined above, our mediator will discuss with you their charges. How long does Family Mediation take?
If you are considering mediation, you should contact our mediator as soon as you can. By doing this we can prevent disputes from worsening. It is also useful to prove to a judge in court that you have attempted mediation and tried to settle disagreements. The time it takes varies based upon each individual case. Sessions can last for a couple of hours and depending on how many sessions are needed could last from a few weeks to a few months.
