How do amputations occur?

There are many ways that an amputation can occur. If it happens as a result of an accident or fall, you may be entitled to claim for compensation if someone else is partly or fully to blame.

If you have suffered an amputation as a result of medical or hospital treatment, our Medical Negligence team can provide you with the legal advice that you need. The medical causes of the amputation might include sepsis or misdiagnosis among others.

What are the legal implications of an amputation?

An amputation can affect your life in many ways.

  • Loss of income if you are unable to work or have to change careers
  • Increased costs if you need specialist accommodation, vehicles or changes to your home
  • Rehabilitation, treatment and ongoing care may be required at different stages of your life
  • You are likely to experience significant distress and inconvenience

We can help you assess your needs for your life after the amputation, to help you plan for the future and secure the right amount of compensation to fully address all of these factors.

When can I make a compensation claim for amputation?

In most cases, claims need to be made within three years from when you either suffered the injuries, or from when you first discovered them. If you are claiming on behalf of a child, you have three years from their 18th birthday to make a claim.

We strongly recommend that you get advice as early as possible and we can advise on the best time to start the claims process based on your circumstances.

How is legal advice funded?

There are various options of funding for claims. Many of our cases are funded using Conditional Fee Agreements, also called a ‘No Win No Fee’ medical negligence claim. In a Conditional Fee Agreement, you will only pay for our solicitors’ work if we win the case for you. We can review and discuss the funding options available to you and help you decide on the best route to take.
