Our team includes specialists whose practice focuses on the following areas of mental health law:

  • complex forensic matters

  • community care issues

The team is also able to refer to specialists within the firm working in other, related areas of law, for example where challenges arise in Mental Health Law cases which require a Public Law approach. Working across Yorkshire and the North of England

Our Mental Health lawyers work in all areas of Yorkshire, Lancashire, Greater Manchester and other areas of the North West of England, as well as Rampton Maximum Security Hospital. We provide advice and representation for clients detained under both civil and forensic sections of the Mental Health Act at Tribunal hearings and appeals before Hospital Managers. Members of the team also work with community-based Mental Health clients.

 

Specialists in Mental Capacity Law

The team also has an extensive and up-to-date knowledge of Mental Capacity Law, particularly as it interfaces with Mental Health law. Switalskis regularly receives referrals from the Official Solicitor to act in Court of Protection matters, particularly where there are welfare issues involved. In this area, our Mental Health lawyers often work closely with our Community Care Law specialists.
