Clinical and Medical Negligence

Help when medical treatment or surgery goes wrong

The medical professional is among the most trusted: every day people put their lives in the hands of doctors, surgeons and other medical professionals. Most of the time, the treatment provided improves the health of patients. Sadly, things sometimes go wrong, and as a result of medical treatment, patients suffer physical or mental injury. Medical mistakes can cause serious distress, injury, or even loss of life.

The Clinical Negligence team at Switalskis is experienced in handling medical negligence claims and helping clients to secure compensation that can make life easier when medical treatment has gone wrong.

Our Wakefield-based medical negligence lawyers can travel to many areas of North, South, and West Yorkshire, the East Riding and Humberside, where appropriate. They may also visit clients at home or in hospital.

Specialists in all types of Medical Negligence claims:

We are specialists in handling all kinds of medical negligence claims, involving a variety of situations and medical conditions, including:

What has to be proved in medical negligence cases?

We need to show that the treatment received was substandard, when compared with the standard of a reasonably competent medical professional in the relevant area of medicine. The burden of proving that the treatment received caused physical harm or financial loss lies with the person making the claim.

We need to show the Court that but for the negligence, the harm would not have occurred in any event. This is, of course, not always straightforward or clear-cut, primarily because the treatment was sought because of the illness. Given that the illness existed prior to the treatment being given, it is difficult, and sometimes impossible, to determine how an illness would have progressed if the condition had been treated in a different way. Therefore, independent medical evidence is generally essential to proving a causal link between the treatment given and the injury or loss.
