What are the benefits of mediation?
Mediation is beneficial in a number of ways:
- There are no 'winners and losers'. Compared to the litigation process mediation can produce fair solutions that both sides are satisfied with. Therefore it is useful where the parties need to continue their relationship - for example where there are children involved.
- The process is informal. Whilst this should not detract from the seriousness of the process, the informality compared with a court hearing can make mediation much less intimidating.
- Mediation will usually be more cost effective than litigation
- It allows you to stay in control of the process, and produce more solutions, rather than handing control over to a judge as would be the case if the matter were resolved in court.
- It is confidential compared to litigation which is a more public process.
