Cohabitation Agreements

What should you include in a cohabitation agreement?

There is no specific law governing cohabitation. Cohabitation agreements are therefore actually drawn up according to contract law.

 

For this reason, they are more likely to be held as legally binding if they are restricted to property and financial matters and do not include details relating to domestic arrangements.

 

In order to ensure that your rights are as well protected as possible, your agreement should cover the following areas:

 

  • Individual ownership of property, including cars, houses etc.
  • Joint ownership of property, especially the family home
  • Mortgage contributions
  • Household bill payments
  • Details of joint and individual bank accounts
  • Financial arrangements relating to any children of the relationship
  • Life insurance and death in service benefits
  • Powers of Attorney
  • Inheritances and gifts
  • Wills
  • You should also include details relating to reviews and termination of the agreement
